ARCREATE takes the protection of your personal data very seriously. We take our responsibilities under applicable privacy laws and regulations ("Privacy Laws") seriously and is committed to respecting the privacy rights and concerns of all Users of our ARCREATE.CO website. By using the Services, registering for an account with us, visiting our Platform, or accessing the Services, you acknowledge and agree that you accept the practices, requirements, and/or policies outlined in this Privacy Policy, and you hereby consent to us collecting, using, disclosing and/or processing your personal data as described herein. If we change our Privacy Policy, we will notify you including by posting those changes or the amended Privacy Policy on our Platform. We reserve the right to amend this Privacy Policy at any time. To the fullest extent permissible under applicable law, your continued use of the Services or Platform, including placing of any orders, shall constitute your acknowledgment and acceptance of the changes made to this Privacy Policy.

RETAINING YOUR PERSONAL INFORMATION We will retain the Personal Information submitted for your user account as long as you maintain an account associated with our Service or so long as we have an ongoing legitimate business need to do so (for example, as is necessary to provide you with the Service, or future email communications from us).
  15. ADDITIONAL INFORMATION. We will maintain Additional Information as long as it is legally permissible in order to improve the performance and features of the Service that we provide.

You acknowledge, consent and agree that ARCREATE may access, preserve and disclose your Account information and Content if required to do so by law or pursuant to an order of a court or by any governmental or regulatory authority having jurisdiction over ARCREATE or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) comply with a request from any governmental or regulatory authority having jurisdiction over ARCREATE; (c) enforce the ARCREATE Terms of Service or this Privacy Policy; (d) respond to any threatened or actual claims asserted against ARCREATE or other claim that any Content violates the rights of third parties; (e) respond to your requests for customer service; or (f) protect the rights, property or personal safety of ARCREATE, its users and/or the public.
  18. As the purposes for which we will/may collect, use, disclose or process your personal data depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of such other purpose at the time of obtaining your consent, unless processing of the applicable data without your consent is permitted by the Privacy Laws.
  19. USER CHOICE; DELETING PERSONAL DATA This section sets out the procedure for accessing, viewing, modifying and deleting your Personal Information. You always have the right to access and correct the Personal Information you have provided and generally you may review, update or delete certain information collected by the Service at any time by following the instructions below.
  20. ACCESSING, MODIFYING AND DELETING OF YOUR USER ACCOUNT. If you have registered a user account on the Service and you need to access, view, correct, or modify your Personal Information associated with that account, we provide you with tools to do so in the account settings. If you would like to permanently delete your user account, you can do so by navigating to your account settings page or by emailing privacy@arcreate.co and requesting that your user account and the associated Personal Information be deleted. We may also delete your account and most of the Information we have collected about you if your account is inactive for a long period of time (but we will try to contact you prior to an account deletion initiated by us). Keep in mind that, we cannot promise that deletion will occur within a specific timeframe. There may be legal requirements to store your Information and we may need to suspend those deletion practices if we receive valid legal process asking us to preserve such Information or if we receive reports of abuse or other Terms violations. Finally, we may also retain certain Information in backup for a limited period of time or as required by law.
  21. REVOKING PERMISSIONS. If you elect to share certain Information with other users of the Service through the Service, you may charge or revoke their permissions by changing the settings in your account settings page. Of course, if you do that, certain collaboration features may lose functionality.
  22. NEWSLETTERS, PROMOTIONAL MATERIALS, SUPPORT COMMUNICATIONS. If you consented to receiving such communications, you can unsubscribe by either following the specific instructions included in such communications or you may “opt-out” of receiving marketing and promotional emails from us at any time by sending an email to us at privacy@arcreate.co detailing your request. Please note that “opt-out” and “unsubscribe” requests may not take effect immediately and may take a reasonable amount of time to receive, process and apply, during which time your Information shall remain subject to the prior privacy settings. Additionally, you should be aware that any Information provided to third parties prior to your election to opt out or unsubscribe cannot be retrieved or rescinded by us unless required by applicable law, and you cannot retroactively opt out or unsubscribe with respect to such third parties through us. We may also have features that allow you to submit information, questions or feedback to us. In those instances, we may retain your emails and other information you submit to us for our internal purposes, and to help us and our Service Providers serve you better.

SECURITY While no data transmission over the Internet is 100% secure from intrusion, we maintain commercially reasonable physical, electronic and procedural safeguards to protect your Personal Information. You acknowledge and agree that we are not responsible for how those third parties collect or use your information.   25. We, and third parties, may from time to time make software applications downloads available for your use via the Platform or through the Services. These applications may separately access, and allow a third party to view, your identifiable information, such as your name, your user ID, your device’s IP Address or other information such as any cookies that you may previously have installed or that were installed for you by a third party software application or website. Additionally, these applications may ask you to provide additional information directly to third parties. Third party products or services provided through these applications are not owned or controlled by ARCREATE. You are encouraged to read the terms and other policies published by such third parties on their websites or otherwise.
  26. INFORMATION COLLECTED BY THIRD PARTIES. Our Platform uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses cookies, which are text files placed on your device, to help the Platform analyse how Users use the Platform. The information generated by the cookie about your use of the Platform (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Platform, compiling reports on website activity for website operators and providing other services relating to website activity and Internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.
  27. WE DO NOT GUARANTEE THE SECURITY OF PERSONAL DATA AND/OR OTHER INFORMATION THAT YOU PROVIDE ON THIRD PARTY SITES. We do implement a variety of security measures to maintain the safety of your personal data that is in our possession or under our control. Your personal data is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the personal data confidential. When you place orders or access your personal data, we offer the use of a secure server. All personal data or sensitive information you supply is encrypted into our databases to be only accessed as stated above.
  28. CHILDREN Our services are not intended for—and we don't direct them to—anyone under 13. We do not knowingly or actively collect Personal Information from children under the age of 13. As a parent or legal guardian, please do not allow such children under your care to submit personal data to ARCREATE. In the event that personal data of a child under the age of 13 in your care is disclosed to ARCREATE, you hereby consent to the processing of the child’s personal data and accept and agree to be bound by this Policy on behalf of such child. We will close any accounts used exclusively by such children and will remove and/or delete any personal data we believe was submitted without parental consent by any child under the age of 13. we will take steps to delete such Personal Information and any associated user accounts.
  29. TRANSFER YOUR INFORMATION OVERSEAS. Your personal data and/or information may be transferred to, stored or processed outside of your country for one or more of the Purposes. ARCREATE will only transfer your information overseas in accordance with Privacy Laws.
  30. ACCURACY It is your responsibility to give us current, complete, truthful and accurate information, including Personal Information, and to keep such information up to date. We cannot and will not be responsible for any problems or liability that may arise if you do not give us accurate, truthful or complete information or Personal Information or you fail to update such information or Personal Information. We will reject and delete any entry that we believe in good faith to be false, fraudulent or inconsistent with this Privacy Policy.
  31. PRIVACY POLICY CHANGES From time to time we may modify this Privacy Policy to reflect changes in the law, our Information collection, use and disclosure practices, features of the Service, or technology or for any other reason. We will let you know about such modification by revising the date at the top of the Privacy Policy that's available on our Services or, in certain cases and at our sole discretion, provide you with additional notice such as adding a statement to our Service homepage or providing you with an in-service notification.
